1. Acceptance of terms
These Terms of Service ("Terms") govern your purchase and use of Clampd hardware (each, a "Chip") and the Clampd mobile application (the "App"), together the "Product," sold and operated by Clampd LLC ("Clampd," "we," "us"). By purchasing a Chip, downloading the App, or otherwise using the Product, you agree to these Terms. If you do not agree, do not purchase or use the Product.
2. The product
Clampd is a passive NFC chip that works with the Clampd App to help you block distracting apps and dismiss alarms by physically tapping your phone to the Chip. The Product is a self-discipline and productivity aid. It is not a medical device, a safety device, a security device, or a substitute for professional advice of any kind, and Clampd makes no claim that it will produce any particular outcome for any particular user.
3. Lifetime limited warranty
Clampd warrants to the original purchaser that a genuine Clampd Chip will not malfunction or fail to read via NFC under normal, intended use, for the lifetime of the original purchaser's ownership of that Chip ("Lifetime Warranty").
What's covered: the Chip malfunctioning or failing to read via NFC during normal, intended use.
Factory defects: a Chip that arrives defective out of the box is handled under the 30-day return window in Section 10, not this Warranty — contact us within 30 days of delivery for a replacement or refund.
What's not covered: damage from accident, drop, misuse, unauthorized modification or disassembly, exposure to conditions outside normal household use, normal cosmetic wear, or loss/theft of the Chip. The Warranty does not cover the App itself, which is provided as described in Section 4.
Remedy: if a Chip is found defective under this Warranty, Clampd will repair or replace it at Clampd's sole discretion, free of charge. A replacement Chip carries the remainder of the original Lifetime Warranty. This is your sole and exclusive remedy for a covered defect. To make a claim, contact hello@clampd.com with proof of purchase and a description of the issue.
4. Disclaimer of other warranties
Except for the express Lifetime Warranty above, the Product (including the App) is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. Clampd does not warrant that the App will be uninterrupted, error-free, or compatible with every device, OS version, or future update to iOS or Android.
5. Alarm & wake-up disclaimer
The Clampd alarm is designed to be difficult to silence without tapping a genuine Chip, but Clampd cannot guarantee that any alarm will wake any user under all circumstances. Phone batteries die, volume can be muted at the hardware level, and mobile operating systems retain their own system-level controls that Clampd cannot fully override. Do not rely on Clampd as your sole method of waking up for anything where being late, or not waking up, could cause serious harm — medical needs, safety-critical duties, or similar. Clampd is not liable for any consequence of an alarm that did not sound, was silenced, or was not heard, including but not limited to missed work, missed travel, missed appointments, or late fees.
6. App-blocking disclaimer
When a focus profile is active, the App restricts access to the apps, sites, and categories you selected. You are solely responsible for choosing what to block and when. Clampd is not liable for missed messages, calls, notifications, work deadlines, or any other consequence of apps being blocked while a profile is active, including situations where you are unable to reach your Chip to end a session.
7. Magnet safety notice
The Chip contains a magnet. Keep it away from pacemakers, implanted defibrillators, and other medical devices, and away from credit/debit cards, hotel keys, external hard drives, and other magnetically sensitive electronics or media, which it may damage or erase. If you or anyone in your household has an implanted medical device, consult a physician before use. Clampd is not liable for damage or injury resulting from the Chip's magnet.
8. Limitation of liability
To the maximum extent permitted by law, Clampd LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to the Product, even if Clampd has been advised of the possibility of such damages. Clampd's total aggregate liability for any claim arising from or related to the Product will not exceed the amount you paid for the specific Chip giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury caused by Clampd's negligence.
9. Indemnification
You agree to indemnify and hold Clampd LLC harmless from any claim, loss, or damage, including reasonable legal fees, arising from your misuse of the Product or your violation of these Terms.
10. Returns & shipping
Unused, unopened Chips may be returned within 30 days of delivery for a refund; see the FAQ for details. A Chip that arrives with a factory defect is also handled within this same 30-day window — contact us for a replacement or refund. The Lifetime Warranty in Section 3 picks up after that: it covers a Chip that malfunctions or stops reading via NFC later, for as long as you own it.
11. Changes to these terms
Clampd may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Product after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of [INSERT STATE], without regard to conflict-of-law principles.
